Head-on Collisions
A head-on collision takes place when the front ends of two vehicles hit each other. In other words, a head-on collision is a crash of two vehicles moving directly toward each other. Head-on collisions typically happen in one of two ways: when a vehicle crosses the centerline or median or when a motorist drives the wrong way down the road.
Unfortunately, an average of 250 people are killed every year in head-on collisions involving highway crossovers, according to the Insurance Institute for Highway Safety. These accidents are up to three times more severe than any other types of highway crashes. In addition, head-on collisions affect rural and urban places differently. The National Highway Traffic and Safety Administration reports that head-on crashes are more prevalent in rural areas making up 13 percent of all rural fatal crashes. In urban areas, head-on crashes account for less than 7 percent of all urban fatal crashes.
Liability After a Head-on Collision
Liability in a head-on collision depends on if either or both driver were negligent at the time of the accident. Negligence is defined that the failure to use reasonable care when doing something, resulting in damage or injury to another. Reasonable care is defined as how a prudent person would have acted in the same or similar circumstances. In order to win a negligence claim, the party filing the lawsuit must establish the following elements:
- Duty: the defendant owed the plaintiff a duty of care;
- Breach: the defendant breached that duty of care by failing to act in a certain way;
- Causation: the defendant’s breach was a direct cause of the head-on collision; and
- Damages: the plaintiff suffered quantifiable damages as a result.
Damages in a Head-on Collision Case
A head-on collision can happen in a split second and can change a person’s life forever. Individuals often suffer serious and life-threatening injuries that can be extremely costly to treat. Some of the types of compensation we will demand after a head-on collision include: current and future medical expenses related to the crash; lost wages as a result of the accident; damage to the motor vehicle; pain and suffering; and, in some cases, punitive damages.
