Personal Injury Lawsuits Involving Massachusetts Pedestrian Injuries and Deaths

Various factors contribute to pedestrian accidents in Massachusetts. Pedestrian accidents are one part of a more extensive set of issues related to road safety in the state. Unsafe pedestrian conduct, driver behavior, and road conditions, among other things, all play a role in these serious accidents. While no single factor is solely responsible for pedestrian-vehicle accidents, a combination of conduct may contribute to this growing problem.

Although anyone can be involved in a pedestrian accident, children and teenagers are particularly high-risk. Walking is a major form of transportation for many teenagers and children in Boston and throughout the state. In addition, many children have the propensity to “dart out” in-between parked cars, and teenagers may be distracted by their phones. Both of these factors make an accident more likely to occur.

While many pedestrian-vehicle accidents involve negligence on the driver\’s part, there are some situations where unsafe pedestrian behavior may lead to the incident. The leading cause of accidents involving unsafe pedestrian conduct include:

  • Pedestrian jaywalking;
  • Pedestrian perception of risk; and
  • Pedestrian impairment because of alcohol or drugs.

Driver negligence, however, is more common in these accidents. Similar to pedestrians, a driver’s perception of risk can cause them to engage in risky conduct. Further, other behavior and conditions that may impact the likelihood of an accident include:

  • Speeding;
  • Impairment;
  • Traffic volume; and
  • The type of vehicle.

The physical environment and layout of a city or town can affect the rates of pedestrian accidents. Areas that lack crossing devices, midblock crosswalks, small road widths, and poor timing of crossing signals all create dangerous pedestrian conditions. Finally, special conditions such as inclement weather, shopping centers, construction sites, and pedestrians with mobility issues make an accident more likely to occur.

Inclement weather is a significant concern, especially as winter approaches in Massachusetts. During bad weather, both pedestrians and drivers often act in haste which can lead to risky behaviors. Moreover, altered walking conditions and reduced visibility can lead to an accident.

Recently, a Massachusetts news report described a pedestrian accident near Norwood. Around 1:00 am, a man was crossing a street when a car slammed into him. The 25-year-old woman remained at the accident scene while paramedics performed life-saving treatment. Investigators reported that the sedan’s windshield was dented and shattered; however, the case is still under investigation.
